Charged with Uttering Threats? Need a BC Criminal Lawyer?

You can be charged with uttering threats if you knowingly utter, convey or cause anyone to receive a threat to:

• Cause death or bodily harm;
• Burn, destroy or damage property; or
• Kill, poison, someone else’s animal or bird.

In order to be found guilty of a criminal charge of uttering threats in British Columbia, the prosecutor must prove you meant to threaten and that your words were to be taken seriously.

For example, if there is reason to believe what you said was in jest or could not be taken seriously by the reasonable person, then you can’t be found guilty of uttering threats in BC.

Maximum sentence for uttering threats

If you the prosecutor proceeds with charging you with an indictable version of uttering threats to cause death or harm to another person, and you are found guilty, you could be sentenced up to 5 years in jail.
