Did you recieve notice from the BC Superintendent of Motor Vehicles stating you have a driving prohibition effective in 21 days?  How about a 24 hour prohibition?

These driving prohibitions can have serious consequences such as:

driving prohibition defences and the process for winning a review.

If you successfully appeal your driving prohibition, you will not be subect the above consequences.

Putting together your best defence of a BC driving prohibition requires analyzing the police documents and evidence that resulted in the BC Superintendent of Motor Vehicles to issue your driving prohition.  The lawyers at Dykstra & Company are criminal defence lawyers experienced at obtaining and analyzing evidence, including police documents and building a defence case.

It is very important that you file your appeal within the stipulated deadline.  Do not wait until it's too late!  You must file your application for review at a BC drivers licence outlet.

We welcome you to speak with us before you file your review appeal.

Ideally, you will talk to us before you apply for a review.  However, if you filed your application for review already (it's better you file it within 7days than wait to speak with us) you can then hire us to prepare the actual review documents and build your review case.  This is where we obtain and analyze your evidence and then build your defence.

Criminal defence attorney Gordon J. Dykstra has the experience and knows the evidence necessary to successfully have a driving prohibition set aside.  Each case is unique, and therefore each case must be assessed on its own by a criminal defence lawyer familiar with the Motor Vehicle Act, reviewing police reports, and building defences to traffic offences including driving prohibitions in BC.

What does it cost to hire us to prepare your driving prohibiton review?

The cost to hire us will depend on a number of factor such as what stage of the review process you are at, whether your review is by written submissions or oral hearing, and the amount of evidence involved.

In many cases, the cost of losing a drivers licence is very high, both financial and in the hardship it causes in your and your family's life.  Find out if you have a case to get rid of your driving prohibition today by calling us or filling out the contact form to the right of this page.

These charges could happen to almost anyone - talk to someone who understands your legal rights to help you take your life back.

Gordon offers the following consultation options:

  • If you've been charged under the Criminal Code (you must go to court):  FREE Consultation.
  • If you’ve received an ADP or IRP call or e-mail Gordon and he will e-mail or fax you a set of instructions on what to do.
  • If after you received those instructions you want Gordon to prepare submissions for you the fee is $750.00.

Contact Gordon today by calling 604-853-4793 (toll free 1-877-753-4793) or by filling out the contact form at the right of this page.

If you have received an Immediate Roadside Prohibition (IRP) from Driving or an Administrative Prohibition from Driving (ADP),  you can call Gordon to find out what you can do and need to do to try and get them cancelled.  For these offences you cannot go to court and make the police prove their case against you. You can only apply to the Superintendent for a cancellation. When you call about an IRP or ADP you will be asked to pay $100.00 to speak to Gordon on the telephone or at the office. If you want to speak to Gordon on the telephone you can arrange to pay the $100.00 on the telephone through your credit card account. If you want to speak to Gordon at the office please bring the $100.00 with you. The aim of the first consultation is to learn if you should put in more time and money to challenge the IRP or ADP.

Once we decide that it may be worth your while to challenge the IRP or ADP the next step is for you to go to the driver’s centre and file for a review. The written review costs $100.00 and if you file and pay the $100.00 you will get a copy of the police report. You will also get a notice that you have to file your response by a certain date. Gordon needs to see that police report to let you know what you can say that might challenge the IRP or ADP. Gordon also needs to know the date by which you have to file your response.

When you have the police report you can come to office to have Gordon review it and tell you what to say or you can fax it to Gordon who will fax or e-mail you back and tell you what to say. To review the report and tell you what to say costs $500.00. If you want Gordon to say it for you, that will cost $2,000.00.

Please be advised that:

  • For ADPs and IRPs/ARPs, Gordon is able to provide more in-depth legal advice if you provide him a copy of the police report before the consultation.
  • Gordon cannot guarantee results of any kind.
